What is Scholastico?

Scholastico is a company providing a series of web-based tools which help schools operate more efficiently.

User Accounts

Each school assigns one person (the Scholastico “client” or “Customer”) to be in charge of their account. This client signs up and pays for the service. Once registered and paid, the client can delegate other people (“admins” or “sub-administrators”) to conduct various processes. This is important because the client is often a busy person, like the school principal or technology director, who doesn’t have time to manage day-to-day operations. Creating a sub-administrator allows the client to delegate tasks to trusted people without having to share their password or credit card information. The client and/or the sub-administrator can create user accounts or configure options. This is done through an easy, intuitive interface. Very little personally identifiable information is collected in this process, and this information is not shared with third parties. See the Scholastico privacy policy for more details about the way we collect and share information.

User’s Age

Scholastico clients must be legally able to agree to these terms and conditions. They may create accounts for sub-administrators or for End Users (including children). Only a minimal amount of personally identifiable information is collected about these users. Our software is designed for use in schools, so we recognize that children will often be using these services. Scholastico clients should not create accounts for users if those accounts will be in violation of local regulations, including online privacy laws or internal school network usage policies.

Payment

Scholastico clients must be legally able to purchase the annual subscriptions through our payment gateway system (i.e., Braintree Payments). This payment gateway has its own separate terms and conditions, as well as privacy policy. You should read the Braintree Paypal policies.

Some Scholastico services are immediately activated upon successful processing of payment. This process is fully automated and shouldn’t take more than a few minutes.  Other Scholastico services require the creation or configuration of web properties, and may take 2 to 3 business days.

What information is requested during account creation?

Scholastico clients must provide the following information when registering their school or organization for an Scholastico account:

  • First Name
  • Last Name
  • E-mail Address
  • Whether they would like only critical emails (like account activation notices, payment invoices, and updates to the privacy policy) or whether they would also like updates about new features of the Scholastico software.
  • Username
  • Name of the school or organization
  • Number of people who will be using the Service (number of students at the school or members in the organization)
  • Timezone

Additionally, clients may choose to provide additional contact information, including their title, their telephone and fax numbers, and their website addresses. This information is not mandatory, but it helps Scholastico contact the client schools in the event that there is a problem with the email or mailing address.

E-mail communication

Privacy is of utmost importance at Scholastico. The information our clients supply during the registration process will not be released or publicly printed on the Internet. We will not nor do we have plans to sell or rent personal information to third parties. We may on occasion contact users about new features or services that have been added to the Scholastico software. For these kinds of mailings we provide an “opt-out” feature on a user’s profile page, and an opt-out link at the bottom of our newsletter or other mailings.. We do reserve the right to contact users for issues that relate to the security of the Scholastico site, important changes to our policies, or the security of a user’s individual account.

Aside from the username, all of a client’s profile information (first and last name, email address, school name and mailing address, timezone, opt-out status, etc) can be changed by a user at any time by signing in and visiting their profile page.

Additionally, an Scholastico client can change their password at any time by signing in and visiting the password change page.

What kind of identifying information is displayed on the web?

Scholastico is not a social network. In general, no identifiable information is displayed publicly on the web. A client must be signed in to see their own personal information. Profile information is not displayed in a way that the general public or search engines will access.

The interfaces that clients or sub-administrators create for their users are displayed on the web. They require users to authenticate (“sign in”) in order to see or interact with the information. The number of end users, the strength of the passwords, and the information shown are all up to the discretion of the Scholastico client or their sub-administrators. Technically, this information is displayed on the web, but not publicly.

Media

Scholastico clients and sub-administrators create and compose interfaces for their end users to interact with. The purposes for these may include signing up for after-school activities, voting in elections, registering for parent-teacher conferences, and others.  Customers may be able to include text or images on their interfaces.  Scholastico clients must take full responsibility for the copyright status of the materials they upload into the system.

How long will information stay on Scholastico?

Client information will remain active on the site indefinitely as long as the client continues to pay his or her account on a regular (i.e, annual) basis. If an account subscription expires, Scholastico will attempt to contact the client. Scholastico reserves the right to put the account on suspension status while seeking payment, during which time the information will remain on the Scholastico servers but may be inaccessible to the client. If, after a reasonable amount of time, the account has not been paid, Scholastico may, at their discretion, deactivate the account and delete the information.

Can I intentionally purge user information, clear voting results, or delete elections?

Yes, if you need to get rid of any data, there are easily accessible purge tools which are designed to do exactly that.

Some school election policies dictate the voting results be kept securely for a certain amount of time, then fully deleted. Storing your results on Scholastico, then purging them, will satisfy these requirements.

Cancelling my Scholastico account

We hope you’ll never want to cancel your subscription, but we want to make it easy for you to do so if you ever need to. Contact info@scholastico.com and we will help you with the cancellation.

Refund Policy

When you cancel, you cancel only future charges associated with your subscription. You may cancel at any time, but the cancellation will become effective at the end of your current billing period. Cancellations are effective the following billing cycle. You will not receive a refund for the current billing cycle. You will continue to have the same access and benefits of your product for the remainder of the current billing period.

We reserve the right to issue refunds or credits at our sole discretion. If we issue a refund or credit, we are under no obligation to issue the same or similar refund in the future.

Terms and Conditions of Service and Use

By accessing the Scholastico web site including its documentation and help files, you are agreeing to be bound by these website Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

Use License

Permission is granted to Scholastico clients and their sub-administrators to access the Scholastico interface authoring and viewing environments on Scholastico’s web site for personal and academic use only. This is the grant of a license, not a transfer of title. The details of this license are as follows:

  • Scholastico is not responsible for the results of your election, or for communicating the results to your voters.
  • Scholastico clients and their sub-administrators may upload their own materials into a an Scholastico online ballot, however the Scholastico client is responsible for any copyright violations that may arise from the use of external images or written material. Scholastico users take full responsibility for the copyright status of the materials they upload into the system. If material has been found to be in violation of this policy, Scholastico reserves the right to remove the offending material and/or deactivate the account in question.
  • You may not modify or copy the Scholastico software or source code.
  • You may not attempt to decompile any software contained on Scholastico’s web site;

 

This license shall automatically terminate if you violate any of these restrictions and may be terminated by Scholastico at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

Use of this Website

The design of the Scholastico website and all text, graphics, stylesheets, information, content, and other material displayed on or that can be downloaded from it are licensed through a Creative Commons Attribution Non-Commercial Sharealike License 3.0. You may borrow from, re-mix, adapt, or resuse the images, text, or videos. You may share the content from the help files and documentation or modify them to help your teachers, students, office staff, parents, voters or sub-administrators, or the general public. The source code and underlying software running Scholastico services is not available under this license. You may not modify, reverse-engineer or access the source code.

No license is granted under this agreement to any recipient of Scholastico software or other products to resell, rent, charge a fee for use or access, or bundle the product with another paid product or service such that access is effectively fee-bearing.

Disclaimers

The materials on Scholastico’s web site are provided “as is”. Scholastico makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Scholastico does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet web site or otherwise relating to such materials or on any sites linked to this site.

You understand and expressly agree that the use of this website and all of its contents is at your sole risk, that any material and/or data downloaded or otherwise obtained through the use of this website is at your own discretion and risk and that you will be solely responsible for any damage to your computer system or loss of data that results from the download of such material and/or such data. Limitation of Liability

Scholastico will not be liable for any direct, indirect, incidental, special, consequential or punitive damages of any kind resulting from the use of or the inability to use this website, resulting from any goods or services purchased or obtained or messages received or transactions entered into through this website, resulting from the loss of, unauthorized access to or alteration of your transmissions or data or for the cost of procurement of substitute goods and services, including but not limited to damages for loss of profits, use, data or other intangibles, even if Scholastico has been advised of the possibility of such damages.

In no event shall Scholastico or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on Scholastico’s Internet site, even if Scholastico or an Scholastico authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

User-created Content

You are prohibited from posting or transmitting any unlawful, threatening, defamatory, libelous, obscene, pornographic or profane material or any material that could constitute or encourage conduct that would be considered a criminal offense or give rise to civil liability, or otherwise violate any law.

Revisions and Errata

The materials appearing on Scholastico’s web site could include technical, typographical, or photographic errors. Scholastico does not warrant that any of the materials on its web site are accurate, complete, or current. Scholastico may make changes to the materials contained on its web site at any time without notice. Scholastico does not, however, make any commitment to update the materials.

Modification to Terms of Use

Scholastico may revise these terms of use for its web site at any time without notice. By using this web site you are agreeing to be bound by the then current version of these Terms and Conditions of Use. Previous versions of the Terms of Use and Privacy Policy may be available through the history feature of the wikimedia or wordpress software. Only the most recent version of these policies will be considered to be in effect. If major changes to the Terms of Use or Privacy Policy are made, Scholastico will attempt to notify its clients via email.

Liability for the content entered by the User

Scholastico shall not be held responsible at all for:

  • correctness, content, functioning or safety of data or content of any users
  • damage (if any) caused due to use or presentation of data or content of any users on the system and in other media
  • illegal acts (if any) of third person, as a result of which these persons may obtain access to the data or content of individual users and/or to their accounts and/or relevant database of Scholastico or its partners using the services , and will not use or misuse the data or content or make them accessible to third persons illegally
  • damage (if any) caused if data or content gets lost or becomes damaged

The User declares that he/she is aware of any and all risks arising for him/her from the aforementioned requirements for the data content entered by him/her. In connection with use of the system, the user especially undertakes not to breach legal standards of his/her country and the copyright license rights held by third parties. The User shall be solely responsible for any data/content he /she has recorded on their system/server and the consequences of publishing them. The user shall be solely responsible for compliance with all provisions of these Usage terms and conditions. The user agrees to indemnify, defend and hold Scholastico, its officers, directors, employees, agents, licensors, suppliers and any third-party information service providers to the Scholastico service harmless from and against all claims. liabilities, losses, expenses, damages and costs, including reasonable attorney’s fees, resulting from (i) any violation of these Usage terms and conditions by user or by any other person accessing the service by using the user’s account and/or (ii) claim that any data or content by the user infringes third party rights

Copyright and other intellectual property rights

The user declares and confirms by recording data and content to the system/server that he/she is the holder of licenses, rights, approvals or permits according to the relevant regulations which entitle the user to upload protected data and content on the system and to use the data/content by communication to public by the Internet without territorial limitation. The user shall not in particular be entitled to store data or content on the system without prior consent granted by the copyright holder or by the owner or the other intellectual property rights.

Governing Law

Any claim relating to Scholastico’s web site shall be governed by the laws of the State of Illinois without regard to its conflict of law provisions.
